AGREEMENT TO BE LEGALLY BOUND By participating in this Ben’s Original Street Food Noodles Chopsticks Offer (the “Offer”), you are signifying that you have read and agree to be legally bound by these Official Terms and Conditions (the “Terms and Conditions”).
SPONSOR AND ADMINISTRATORS This Offer is sponsored by Mars Canada Inc. (the “Sponsor”).The Offer is being administered on behalf of the Sponsor by MARS‑Philter, Inc. d/b/a Mars United Commerce and Elite Digital Inc. (together, the “Administrators”).
ELIGIBILITY The Offer is open to legal residents of Canada who, at the time of participation:
Have reached the age of majority in their province or territory of residence,
Are physically located in and are legal residents of Canada, and
Have a valid email address and mailing address in Canada.
The Offer is not open to employees, officers, directors, representatives or agents of the Sponsor, the Administrators, their respective parent, related or affiliated companies, advertising or promotional agencies, fulfillment agencies, or any other entity involved in the administration of this Offer, or any member of the immediate family or household of any of the foregoing persons.For the purposes of these Terms and Conditions, “immediate family” means mother, father, siblings, children, and spouse or common law partner, irrespective of place of residence.The Offer is intended for individual consumer use only. Groups, clubs, organizations, commercial or non commercial entities, and resellers are not eligible to participate.Void where prohibited, restricted or taxed by law.
OFFER PERIOD AND KEY DATES The Offer is planned to run during the following periods, subject to change as set out below:
Purchase Period Participating Ben’s products must be purchased between March 15, 2026 and June 30, 2026 (the “Purchase Period”), while supplies of Rewards last, as set forth in Section 7 of these Terms and Conditions.
Submission Period All online submissions (each a “Submission” or “Request”) must be received on or before July 3, 2026 AT 11:59:59 P.M. ET (the “Submission End Date”), in accordance with these Terms and Conditions (together with the Purchase Period, the “Offer Period”), provided that this Offer may close earlier as set forth in Section 7 of these Terms and Conditions.
The Sponsor reserves the right, in its sole and absolute discretion, to change the Purchase Period, Submission End Date and or Offer Period, and will update the Offer website and or promotional materials if this occurs.The sole determinant of the time for the purposes of this Offer will be the official time keeping device or devices used by the Administrators.
PARTICIPATING PRODUCTS AND QUALIFYING PURCHASES For the purposes of this Offer:
“Participating Products” means:
Any BEN’S ORIGINAL™ Street Food Noodles product sold in Canada.
A “Qualifying Purchase” consists of at least:
Two (2) BEN’S ORIGINAL™ Street Food Noodles products, purchased together in a single transaction, such that both Participating Products appear on the same cash register or online receipt (a “Receipt”).
Purchases must be made:
From any retailer in Canada that sells Participating Products to consumers in Canada, and
Either in-store in Canada or via a Canadian online retailer or the Canadian website of a retailer selling Participating Products.
Online purchases are eligible on the same basis as in store purchases, provided all requirements of these Terms and Conditions are met.Receipts obtained via unauthorized means or illegitimate channels, including without limitation, from any seller not legitimately selling Participating Products to consumers in Canada, will be void.
REWARD DESCRIPTION Each verified Qualifying Purchase submitted in accordance with these Terms and Conditions, while supplies last, will receive one (1) Reward, consisting of the following items:
One (1) pair of Ben’s branded wooden chopsticks, and
One (1) Ben’s branded chopsticks case (collectively, a “Reward”).
Rewards must be accepted as awarded.Rewards are not transferable or assignable, have no cash value, and are not redeemable for cash or any other form of credit.The Sponsor reserves the right, in its sole and absolute discretion, to substitute the Reward or any component with a comparable item of equal or greater value, including if the advertised Reward becomes unavailable for any reason.
REWARD POOL AND “WHILE SUPPLIES LAST” The Sponsor is planning a national allocation of approximately 15,000 Rewards for this Offer, subject to availability.The Offer is “while supplies last” and may conclude before the Submission End Date if all available Rewards have been allocated and or awarded.The Sponsor does not guarantee that every Qualifying Purchase will receive a Reward, and participation may be closed without prior notice once available Rewards have been exhausted.In the event that all Rewards have been allocated, the Offer will be deemed terminated and the Sponsor may, but is not obligated to, post a notice to that effect on the Offer Website and or through other promotional materials.
LIMITS AND STRUCTURE OF PARTICIPATION Subject to the availability of Rewards and all other conditions herein:
There is no maximum number of Rewards per person or per household, provided that:
Each Reward is associated with a unique and valid Qualifying Purchase, and
Each Receipt is only used once and is not reused or submitted more than once.
Limit of one (1) Reward per Receipt, regardless of the number of Qualifying Purchase pairs shown on that Receipt.For example, if a Receipt shows the purchase of four (4) Participating Products that would otherwise constitute two (2) potential Qualifying Purchase pairs, only one (1) Reward will be issued for that Receipt.
Multiple Receipts may be submitted by the same individual, as long as each Receipt:
Documents at least one Qualifying Purchase,
Has not been previously used in this Offer or any other promotion, and
Complies with these Terms and Conditions.
Each Receipt may only be submitted once in this Offer. Duplicate, repeated or shared Receipts will be rejected and may result in disqualification and or other remedies as set out in these Terms and Conditions.The Sponsor and Administrators reserve the right, in their sole and absolute discretion, to:
Reject or invalidate any Submissions or Receipts that appear to be bulk, group or commercial in nature, or not in keeping with the letter and spirit of the Offer,
Impose reasonable limits on the number of Rewards issued to any individual, email address, household or mailing address if suspicious activity or abuse is suspected.
HOW TO PARTICIPATE To participate in the Offer, an eligible participant (a “Participant”) must complete all of the following steps.(a) Make a Qualifying Purchase During the Purchase Period, purchase Participating Products in a single transaction as described in Section 5, ensuring that the Receipt clearly identifies:
The retailer,
Transaction date and time,
Each Participating Product purchased, and
Purchase price for the Participating Products.
(b) Register and Submit Online On or before the Submission End Date or earlier if supplies have run out:
Complete the online registration form with true, accurate and complete information, including, but not limited to:
Full first and last name,
Valid email address,
Complete street mailing address in Canada, including postal code,
A street address that can accept standard delivery or courier is required. P.O. Boxes are not eligible.
Confirmation of age of majority and eligibility, and
Acceptance of these Terms and Conditions and any other forms or acknowledgements required by the Sponsor or Administrators.
(c) Upload Receipt Image
Take a clear photograph or scan of your entire Receipt (or save your online order confirmation or receipt as a PDF), showing all required information,
Upload the image in one of the accepted file formats (for example, jpg, jpeg, png, pdf or tif) up to the maximum file size indicated on the Offer Website, and
Follow on screen instructions to finalize your Submission.
(d) Submission Timing All Submissions must be received by the earlier of:
11:59:59 p.m. ET on the Submission End Date, or
The date on which the national supply of Rewards has been fully allocated and or exhausted.
Submissions that are incomplete, illegible, improperly formatted, or do not comply with these Terms and Conditions may be rejected.(e) Mobile Devices and Data Charges If you participate in the Offer using a mobile device, you may incur standard data charges from your wireless service provider. Check with your wireless service provider for details on these and other applicable charges. Participants are solely responsible for any such data charges.
PROCESSING, VERIFICATION AND RECEIPT VALIDATION Processing of Submissions will typically take up to 7 business days from the date the Submission is received by or on behalf of the Sponsor. Processing times may vary and may be longer due to high volume, additional verification needs or other circumstances. No responsibility is accepted for delays in processing, and no separate notice of extended processing times will be sent.Following processing, the Participant will usually receive an email notification advising:
That the Submission has been successfully validated and a Reward will be issued, or
That the Submission could not be validated and, where permitted, a brief description of the issue and whether the Participant may resubmit a corrected image while the Offer remains open.
The Sponsor and Administrators reserve the right, in their sole and absolute discretion, to require at any time:
The original paper Receipt or proof of online purchase,
Additional documentation or information, and or
Proof of identity, age and address, such as government issued photo identification,
for the purposes of verifying eligibility and compliance with these Terms and Conditions. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified may result in disqualification.Receipts will be rejected and Submissions may be void if, in the sole and absolute discretion of the Sponsor or Administrators, they:
Fail to pass anti fraud, security or validation checks,
Are illegible, unreadable, incomplete, altered, damaged or blank,
Do not clearly identify the retailer, date, time, Participating Products and purchase prices,
Show Participating Products that are refunded, returned or exchanged,
Show the use of unauthorized or fraudulent coupons, rebates or discounts,
Contain store level or system errors, price look up codes, or other markings that may indicate they are not legitimate consumer Receipts,
Have been previously used in this Offer or any other promotion,
Are duplicates of another Receipt submitted in this Offer, including where the same Receipt has been submitted by more than one person, or
Are identified by the Sponsor or Administrators as fake, unauthorized, obtained through illegitimate channels, or otherwise not in compliance with these Terms and Conditions.
Proof of transmission or attempted transmission, such as a screenshot, “sent” confirmation or similar, does not constitute proof of receipt by the Sponsor or Administrators.All Submissions, including Receipts and any accompanying materials, become the property of the Sponsor upon receipt and will not be returned.
DELIVERY OF REWARDS Participants whose Submissions are validated and who are confirmed as eligible will have their Rewards fulfilled as follows:
Rewards will be shipped by or on behalf of the Administrators to the Canadian street mailing address provided by the Participant at time of registration, and
Participants should allow approximately 4 to 8 weeks from the date of successful validation for delivery of the Reward. Delivery times may be longer to remote or rural areas.
No responsibility is accepted by the Sponsor or the Administrators for:
Late, lost, stolen, damaged, misdirected, mutilated, delayed or undeliverable Rewards or communications, whether caused by postal or courier issues, incorrect or incomplete address information, or otherwise,
Any Reward once it has been handed over to the postal service or courier, or
Any inability of a Participant to accept or receive a Reward for any reason.
Rewards that are unclaimed, undeliverable or returned as undeliverable may not be re sent, and may be forfeited.
PRODUCT SAFETY AND USE The Reward chopsticks and chopsticks case are intended solely for normal consumer use in accordance with any instructions, warnings or guidelines provided by the manufacturer and or Sponsor.Participants are responsible for using the Reward safely and appropriately, especially around children.The Sponsor and Administrators make no warranties or representations, express or implied, regarding the safety, fitness for a particular purpose or merchantability of the Reward, except as may be required by applicable law.If any specific Health Canada or other safety warnings are required by law or manufacturer guidance, such warnings are deemed incorporated into these Terms and Conditions and may be communicated via packaging, the Offer Website and or other channels.
RETURNS, ABUSE AND FRAUD If a Participant returns Participating Products for a refund after receiving a Reward, the Sponsor reserves the right to:
Invalidate the associated Reward, and or
Require repayment of the Reward value where appropriate,
and may contact the Participant by email to coordinate repayment or other remedies consistent with applicable law.Anyone the Sponsor reasonably believes to have engaged in:
Fraudulent behavior,
Receipt reuse or manipulation,
Bulk acquisition of Rewards inconsistent with consumer purchasing behavior,
The use of automated systems, scripts, bots or other means to submit or generate Submissions, or
Any activity that is not in keeping with the letter and spirit of the Offer,
may be disqualified from the Offer in the sole and absolute discretion of the Sponsor or Administrators, and may be subject to any other remedies available at law.
AUTHORIZED ACCOUNT HOLDER In the event of a dispute regarding who submitted a Submission, the authorized account holder of the email address submitted at the time of participation will be deemed to be the Participant.“Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.A Participant may be required to provide proof that they are the authorized account holder of the email address associated with the Submission.
GENERAL CONDITIONS, RELEASE AND LIMITATION OF LIABILITY By participating in this Offer, Participants:
Agree to be bound by these Terms and Conditions and all decisions of the Sponsor and Administrators, which are final and binding in all matters relating to the Offer, and
Release and hold harmless the Sponsor, the Administrators, their respective parent, subsidiary and affiliated companies, advertising and promotion agencies, fulfillment agencies, and each of their respective officers, directors, employees, representatives, agents, successors and assigns (collectively, the “Released Parties”) from any and all liability, claims or damages arising out of or in any way connected with:
Participation in this Offer,
The processing, validation or administration of Submissions,
The allocation, delivery, acceptance, possession, use or misuse of any Reward, or
Any activity related to the Offer.
To the fullest extent permitted by law, the Released Parties will not be liable for:
Any failure of websites, servers, networks or hardware,
Any technical problems or traffic congestion on the internet or at any website,
Any incorrect or inaccurate information related to or used in connection with the Offer,
Any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction or unauthorized access,
Any technical problems or malfunctions in relation to telephone networks or lines, computer systems, servers, access providers, computer equipment or software, or
Any injury or damage to a Participant’s or any other person’s computer or device related to or resulting from participation in the Offer.
The Released Parties do not assume any responsibility and are not responsible for electronic communications that are undeliverable for any reason, including as a result of any form of active or passive filtering of any kind, or insufficient space in a Participant’s mailbox or device to receive email messages or other communications.WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS OFFER, INCLUDING THE OFFER WEBSITE AND ALL REWARDS, IS PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT OR TITLE, EXCEPT AS MAY BE EXPRESSLY PROVIDED BY THE SPONSOR OR REQUIRED BY APPLICABLE LAW.If any event beyond the reasonable control of the Sponsor, including but not limited to an act of God, pandemic, public health emergency, strike, lockout or other labour dispute, war, riot, fire, flood, or government action, interferes with the proper conduct of the Offer, the Sponsor reserves the right, in its sole and absolute discretion, to modify, suspend or terminate the Offer, in whole or in part, without prior notice, subject to applicable law.The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Offer, or to amend any portion of these Terms and Conditions, including the Reward pool, in any way and for any reason, at any time, with or without notice, subject to applicable law.If any term of these Terms and Conditions is found to be invalid, illegal or unenforceable, such term shall be severed, and the remaining terms shall be construed and enforced to the fullest extent permitted by law.Any attempt to deliberately undermine the legitimate operation of the Offer may be a violation of criminal and civil laws. If such an attempt is made, the Sponsor reserves all rights and remedies, including the right to seek damages to the fullest extent permitted by law.By participating, Participants consent to the use of their first name and city and province of residence for advertising and promotional purposes related to the Offer, in any media now known or hereafter developed, without further notice or compensation, except where prohibited by law.
PRIVACY Personal information collected in connection with this Offer will be used by the Sponsor and Administrators solely for the purposes of administering the Offer, processing Submissions, fulfilling Rewards and for other purposes described in these Terms and Conditions or as otherwise permitted or required by law.With the Participant’s consent, the Sponsor may also use personal information to provide information about products, services or promotions in accordance with its privacy policy.Personal information will be handled in accordance with the Sponsor’s privacy policy and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any substantially similar provincial legislation.For more information about how the Sponsor collects, uses and discloses personal information, please see the Sponsor’s privacy policy at: https://www.mars.com/privacy/
DISPUTES, GOVERNING LAW, LANGUAGE AND INTERPRETATION To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of Participants and the Sponsor in connection with the Offer, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules.Any disputes will be resolved in the courts of the Province of Ontario, and the parties hereby consent to the exclusive jurisdiction of such courts.To the extent permitted by applicable law, all causes of action arising out of or connected with this Offer or any Reward shall be resolved individually, without resort to any form of class action.To the extent permitted by applicable law, under no circumstances will a Participant be permitted to obtain awards for punitive, incidental, consequential, or any other damages, other than for actual out of pocket expenses, and each Participant hereby waives any and all rights to claim punitive, incidental, consequential or any other damages, and any and all rights to have damages multiplied or otherwise increased. To the extent permitted by applicable law, any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, excluding legal fees and court costs.In the event of any discrepancy or inconsistency between these Terms and Conditions and any disclosures or other statements contained in any Offer related materials, including without limitation, point of sale materials, online, television, radio or print advertising, or other marketing materials, these Terms and Conditions shall prevail, govern and control.In the event of any discrepancy between the English version of these Terms and Conditions and any French translation, the English version will prevail to the extent permitted by law.
